Welcome to MycoData (the “Site”), a medicinal and functional fungi research database. These Terms of Use (the “Terms”) govern your access to and use of the Site. In these Terms, “MycoData,” “we,” “us,” and “our” refer to the operator of the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Research and informational purpose only
The Site provides curated metadata, summaries, and links to third-party scientific literature about medicinal and functional mushrooms, for general research and informational purposes only. Nothing on the Site is medical, health, dietary, or professional advice, and it is not a substitute for consultation with a qualified healthcare provider. Never disregard or delay seeking professional advice because of something you read on the Site. Statements about mushrooms or compounds have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.
2. Permitted use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Site for your own research and reference. You may not use the Site except as expressly permitted in these Terms.
3. Prohibited conduct
You agree that you will not, and will not permit others to:
- copy, reproduce, mirror, republish, distribute, sell, license, or otherwise exploit any part of the Site or its database for any commercial or public purpose without our prior written permission;
- use any robot, spider, scraper, crawler, or other automated means to access, monitor, index, or extract data from the Site, or to download or harvest content in bulk;
- circumvent, disable, or interfere with security, access-control, or rate-limiting features of the Site;
- frame, mirror, or create a derivative or competing database or service using content obtained from the Site;
- reverse engineer or attempt to derive the source code or underlying structure of the Site; or
- use the Site in any way that violates applicable law or infringes the rights of others.
4. Intellectual property
The Site, including its selection, arrangement, organization, and compilation of data, together with its design, text, graphics, and software, is owned by MycoData and is protected by copyright, database, and other intellectual-property laws. The underlying scientific works referenced on the Site remain the property of their respective authors and publishers; the Site links to or summarizes such works and does not claim ownership of them. All rights not expressly granted are reserved.
5. Researcher submissions and accounts
If you register or submit content (such as study references) to the Site, you represent that you have the right to do so and that your submission is accurate and does not infringe any third-party rights. You grant MycoData a non-exclusive, royalty-free, worldwide license to review, store, display, and use your submission in connection with operating the Site. We may accept, reject, edit, or remove submissions at our discretion, and submissions are reviewed before any public display. You are responsible for use of your account.
6. Third-party content and links
The Site references and links to third-party websites, databases, and publications that we do not control. We are not responsible for the availability, accuracy, or content of any third-party resource, and links do not imply endorsement.
7. Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or that any content is complete or current.
8. Limitation of liability
To the fullest extent permitted by law, MycoData and its operators and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or relating to your use of the Site, even if advised of the possibility of such damages.
9. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted on this page with an updated “Last updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
